The undersigned understands that upon the signing of this agreement, he does promise to pay ELITE PERSONAL FITNESS, Columbus Michigan The Total Cost for which he shall be considered a member for the entire term specified herein, irrespective of the amount of service the undersigned uses at ELITE PERSONAL FITNESS Columbus Michigan. He also does acknowledge and agree to follow the rules and regulations set forth within this agreement and any additions or changes or amendments thereto by ELITE PERSONAL FITNESS. ELITE PERSONAL FITNESS, Columbus, MI does hereby agree to give the undersigned the right to its facilities during regular hours until the expiration date as specified below. In addition, this agreement is not transferable, not cancelable by the undersigned, and not refundable, and this agreement shall remain subject to all conditions set forth within this agreement. It is also in agreement that ELITE PERSONAL FITNESS, Columbus Mi reserves the exclusive right to reject this application at any time during the term of this agreement, and the revocation of any of the terms of this agreement by a court of law shall not serve to cancel the entire agreement, which shall remain in full force and effect.
EXERCISE APPAREL: Suitable clothing must be worn at all times in the exercise area. This shall include some type of T-shirt or sweatshirt, workout shorts or sweatpants, and tennis shoes. Items such as, but not limited to, boots, jeans, button down shirts and other street clothes are not permitted in the workout area.
LIABILITY WAIVER: It is expressly agreed that all use of the fitness facilities shall be undertaken by a member at his or her sole risk, and the Club shall not be liable for any injuries or damage to any member or guest, or the property of any member or guest, or to be subject to claim, demand, injury or damages whatsoever, including, without any limitations, these damages resulting from any acts or active or passive negligence on the part of the Club, its successors or assigns, as well as its officers and agents, for all such claims, demands, injuries, damages, actions or causes of actions. It is specifically agreed that the Club shall not be responsible or liable to members or their guests for articles lost or stolen in the Club. The Club also shall not be responsible or liable for loss or damage to any other property of members or their guest, including automobiles and content. It is also agreed that any damages to the Club facilities or property, or to the property of any member by another member or his guest, is the sole responsibility to the offending member.
Notice of Cancellation - The contract may be cancelled by you for any reason before midnight of the third business day after the day upon which you receive your initial service under the contract or before midnight of the second business day after the day upon which you sign the contract: whichever occurs first, and of the services or facility that is the subject matter of the contract is not made available when you sign the contract, you may then cancel the contract any time before midnight of the seventh business day after the day upon which you receive your initial service under the contract. If you cancel during this period the seller must send you a refund in full for any money you have paid, except that a reasonable expense fee, not to exceed ten dollars, see attached. The seller must then also cancel and return to you within twenty business days any and all papers you have signed. To cancel this contract, either deliver or mail the signed as dated copy of this Notice of cancellation or any written notice, or signed telegram to ELITE Personal Fitness, 10352 Gratiot, Columbus, MI 48063.
Notice 1 - ELITE Personal Fitness urges all members to obtain a physical examination from their physicians prior to the use of any exercise class. In recognition of the possible dangers connected with any physical activity, member(s) hereby knowingly and voluntarily waive their right or cause of action of any kind whatsoever arising as the result of such activity from which any liability may or could accrue to ELITE Personal Fitness, its officers, owners, agents, employees, or instructors.
Notice 2 - If by any reason of death or permanent disability, the member is unable to complete the training program, he and his estate shall be relieved from the obligation of making payment for training other than that received prior to death or the onset of disability, and that of he has prepaid any sum for training, that amount shall be promptly refunded.
Notice 3 - Should member(s) permanently move their residence more than twenty five (25 miles from an affiliated area, payment on this agreement shall be suspended upon payment of an appropriate cancellation fee of $50.00 and legitimate verification of the move.
Notice 4 - While on the premises of the club, you are granting your permission to be filmed, videotaped, audio taped or photographed by any means and are granting full use of your likeness, voice and words without compensation.
1. Compliance with rules and conduct of member - Member agrees to be subject to the guidance of the club staff while on the premises and will follow instructions of club personnel. Member agrees to obey all rules and conditions of membership in this contract or in the future prescribed by the club and the club reserves the right to revoke or terminate the membership if the member fails to keep and obey any of such rules and conditions.
2. Signing In - All members upon entering the club are required to sign in at the front counter using your key FOB.
3. Equipment malfunctions - Member understands the equipment may, from time to time, be out of order. When proprietary factory parts must be ordered, some units may be out of order for several weeks. When this occurs, the member agrees to follow a regulated substitute program.
4. Damage to facilities - Member agrees to pay an extra charge for damage arising from any careless use of the equipment, or dropping of weights, ect. caused by member.
5. Personal Property - The club, and its owners, and the agents, and employees of both shall not be responsible for damaged, lost, or stolen articles of clothing or any other personal property of any member.
6. Smoking is not permitted in any part of the club, including the locker room area. No food or drink is allowed in exercise areas except bottled water.
7. No members are allowed behind the front counter.
8. No alcoholic beverages, or illicit drugs, including anabolic steroids, are allowed on the premises of the club.
9. Weight plates must be put back on the weight racks after use. DO NOT lean the weight plates against the equipment or lay them on the floor.
10. Lockers are available for use while visiting our facility. However, locks will not be provided. If you bring your own lock, you must remove it before you leave. If a member’s lock is left on a locker after the member has left the club, the lock will be subject to removal, and ELITE Personal Fitness will not be obligated to replace the lock.
11. Amending the rules - The club reserves the right to amend and/or add to these rules and conditions and to adopt new rules and conditions as it may deem necessary for the proper management of the club.
